Privacy Policy
How IndiaNiva handles your personal data under EU GDPR and German law.
IndiaNiva is currently in Phases 1 and 2 of a five-phase journey. This Privacy Policy reflects current data collection during these phases (waitlist email, Tailor Directory submissions, and IP-anonymised analytics). A complete, lawyer-reviewed Datenschutzerklärung will be published before Phase 3 — the online shop launch, when additional data (orders, addresses, payment) will be processed. A further data-handling extension will be added before Phase 5 — IndiaNiva Occasion Rental, which will introduce rental-specific data flows (deposit handling, condition photos, customer verification).

2. What data we collect
2.1 Waitlist signup (Newsletter)
When you join our launch waitlist, we collect:
— Your name
— Your email address
— Your city (optional)
— Your country (to plan EU rollout)
— Your explicit consent to receive IndiaNiva updates
This data is stored securely within our WordPress site (hosted with Hostinger in the EU) and used solely to send you saree guides, styling and drape notes, and your invitation when the online shop launches. We send no more than two emails per month. See our Newsletter Privacy Notice for full details.
2.2 Server logs
Like all websites, our server automatically records standard technical data: IP address (anonymised), browser type, page visited, referrer, and time of visit. This is used solely for security and basic site analytics.
2.3 Cookies and analytics
We use a cookie consent banner (Complianz) to ask your permission before any non-essential cookies are set. If you accept analytics cookies, we use Google Analytics 4 with IP anonymisation enabled to understand how visitors use the site. You can decline this at any time via the cookie banner or via the “Cookie Settings” link in our footer.

2.4 User-Generated Content (UGC)
If you submit photos, reviews, or testimonials to IndiaNiva, we collect the content and any associated information (name, email) you provide with your submission. See our Terms of Use for the full UGC policy, including how you grant us permission to use the content and how to request removal.
2.5 Tailor Directory submissions
IndiaNiva operates a public Tailor Directory at /tailor-directory/ — a free, open directory of trusted Indian tailors in Germany and Europe. Anyone can submit a tailor (themselves or someone they recommend) via our submission form. We collect two distinct sets of data, and you must understand what each one is used for before submitting.
About you (the person submitting):
— Your name
— Your email address
— Whether you are the tailor or recommending someone else
— Your IP address (collected automatically for spam prevention)
— Three explicit consent checkboxes (permission, verification, privacy)
This data is used to contact you about the submission and is never published publicly. It is visible only to IndiaNiva administrators.
About the tailor:
— Business name
— Full street address (street name, house number, postal code, city, country)
— Services offered
— Languages spoken
— Years of experience
— Working from (shop / home / both)
— Website, Instagram, or Google Maps link
— Optional: phone number and email address (admin-only — never published)
— Optional: a short description of their work (admin-only — never published)
What is publicly displayed on the directory:
The tailor’s business name, full address, services, languages, years of experience, and “More →” link (to their external Instagram / Google Maps / website) appear publicly on the directory page. The tailor’s phone number, email, and any submitter notes never appear publicly and are stored only for IndiaNiva’s internal verification.
Verification process: Before publishing any listing, IndiaNiva personally contacts the tailor (using the submitted phone, email, or via their own external page) to confirm they consent to being listed. Submissions are rejected if we cannot reach the tailor or if the tailor declines.
Legal basis: Consent (GDPR Art. 6 §1 a) — submitters confirm they have permission from the tailor to share the contact information, and the tailor confirms their consent during our verification call.
Right to be removed: Any listed tailor (or anyone with legitimate authority to act on their behalf) can request immediate removal of their listing by emailing info@indianiva.com. We process removal requests within 14 days, and typically much faster.
2.6 Future data flows (not yet active)
The following data flows are not currently in operation and are disclosed here only as forward-looking transparency. Each will be introduced with its own updated Privacy Policy section before going live:
— Phase 3 — Shop orders: Customer name, shipping and billing address, order history, payment information (processed by Stripe or equivalent — we do not store full card numbers), email and phone for order communication.
— Phase 4 — Partnerships: Limited business contact data for wedding planners, photographers, mehendi/makeup partners, and Indian shop owners we partner with.
— Phase 5 — Rental: For IndiaNiva Occasion Rental, additional data will include verified ID information for high-value rentals, condition photographs (pre-ship and post-return), security deposit hold records, and event-related information (event date and type). This will require its own separate consent flow and updated Datenschutzerklärung before launch.
3. Legal basis for processing (GDPR Art. 6)
Consent (Art. 6 §1 a): For waitlist signup, optional analytics, UGC submissions, and Tailor Directory submissions.
Legitimate interest (Art. 6 §1 f): For server logs needed to operate and secure the website, and for spam-prevention IP logging on the tailor submission form.
Contract (Art. 6 §1 b): Will apply later for order processing once the shop is live (Phase 3), and for rental contracts in Phase 5.
4. How long we keep your data
— Waitlist email signups: kept until you unsubscribe or for a maximum of 3 years from the date you joined, whichever comes first.
— Server logs: deleted automatically after 30 days.
— Cookie consent records: kept for 12 months, as required for proof of consent.
— User-Generated Content: kept while your submission remains published, or until you request removal.
— Tailor Directory listings: kept for as long as the tailor remains listed in the directory. Upon a removal request, the listing is unpublished within 14 days and the underlying data deleted within 12 months. Submitter information (name, email, IP) is kept for 12 months after submission for verification purposes, then deleted.
5. Who we share your data with
We do not sell your data. We share it only with the technical service providers needed to operate the site, all of which are GDPR-compliant:
— Hostinger (EU hosting, with a Data Processing Agreement)
— Google (Analytics + Fonts — only if you consent to analytics cookies)
— WPForms (waitlist form processing, data stored on our server)
— Complianz (cookie consent management)
Public visibility of Tailor Directory data: Note that tailor listings published in the directory (name, address, services, languages, working from, external link) are visible to all visitors of indianiva.com and may be indexed by search engines. This is the publication’s intended purpose. Tailor phone number, email, and any submitter notes are not part of the public listing and are stored only for IndiaNiva’s internal use.
6. Your rights under GDPR
You have the right to:
— Request access to the data we hold about you
— Request correction of inaccurate data
— Request deletion of your data (“right to be forgotten”)
— Withdraw consent at any time
— Restrict processing
— Receive a copy of your data in a portable format
— Object to processing
— Lodge a complaint with the Bavarian Data Protection Authority (BayLDA)

7. Data security
Your data is stored on EU servers, transmitted over HTTPS encryption, and protected by industry-standard security measures (Wordfence firewall, regular backups, strong admin passwords with two-factor authentication).
8. International data transfers
Some service providers (e.g. Google) may transfer data outside the EU. In such cases, we rely on EU-approved Standard Contractual Clauses and additional safeguards to ensure your data remains protected under GDPR-equivalent standards.
9. Children’s data
IndiaNiva is not directed at children under 16. We do not knowingly collect data from minors. If you believe a minor has signed up to our waitlist or submitted a tailor, please contact us and we will remove the data.
10. Changes to this policy
This Privacy Policy will be updated as IndiaNiva evolves through its five phases. The next major update will accompany the Phase 3 online shop launch, when commercial data processing begins. A further update will accompany Phase 5 (rental). The “Last updated” date below shows when changes were last made.
This Privacy Policy is a starting structure only. Before the formal Phase 3 shop launch, the complete and final Datenschutzerklärung must be generated using a trusted German legal text generator (e.g. eRecht24.de) and reviewed by a qualified German Anwalt or Datenschutzbeauftragter. A separate professional review will be needed before Phase 5 (rental) introduces its additional data flows.
