Terms of Use

The rules and conditions for using indianiva.com during Phases 1 and 2 of our five-phase journey.

Phases 1 and 2 version

IndiaNiva does not currently sell any products or services. The online shop launches as Phase 3 of our five-phase journey. These Terms of Use cover only the use of the indianiva.com website during Phases 1 and 2 (brand foundation and Tailor Directory growth) — saree guides, waitlist signup, the Tailor Directory, and brand content.

Full Allgemeine Geschäftsbedingungen (AGB) governing online sales, returns, warranties, withdrawal rights (Widerrufsbelehrung), and shipping will be published before the shop opens, generated through a qualified German legal text provider. A further separate AGB will be drafted before Phase 5 — IndiaNiva Occasion Rental, since rental contracts are legally distinct from sale contracts under German law.

2. About this website

indianiva.com is currently in Phases 1 and 2 of a five-phase journey. It offers:

— Free educational content about Indian sarees, fabrics, and styling
— A waitlist signup form for our shop launch (Phase 3)
— A live Tailor Directory of trusted Indian tailors across Germany and Europe (the heart of Phase 2)
— Brand background, journey updates, and contact information

Future phases will introduce additional services governed by separate terms: the ecommerce shop (Phase 3), expanded partnerships (Phase 4), and IndiaNiva Occasion Rental (Phase 5).

3. Use of the website

By using indianiva.com, you agree to:

— Use the site for lawful purposes only
— Not attempt to disrupt, hack, scrape, or overload the site
— Respect copyright and not redistribute content without permission
— Submit accurate information when signing up to the waitlist or submitting a tailor

4. Waitlist signup

By joining the IndiaNiva waitlist, you consent to receive saree guides, styling and drape notes, and launch notifications by email — no more than two emails per month. You can unsubscribe at any time using the link in any email, or by writing to info@indianiva.com.

The waitlist is a free service. It does not constitute a contract for sale and does not guarantee availability of any specific product when the shop launches. See our Newsletter Privacy Notice for full details.

5. Intellectual property

All content on indianiva.com — including text, images, logos, design, photographs, and code — is the intellectual property of IndiaNiva (Valentine Pereira) unless otherwise stated. You may not reproduce, redistribute, or use this content for commercial purposes without written permission.

You are welcome to share links to our pages on social media, and short excerpts may be quoted with attribution.

6. User-Generated Content (UGC)

IndiaNiva accepts customer photos, reviews, and testimonials submitted with explicit permission. When you submit UGC, you confirm and agree to the following:

6.1 Your rights

— You own the content you submit, or have full permission from any people pictured to share it
— All people clearly identifiable in the submission have given consent
— The content does not infringe any third-party rights (copyright, trademark, privacy)
— You are at least 18 years old, or have parental consent

6.2 Permission you grant IndiaNiva

By submitting content, you grant IndiaNiva a non-exclusive, royalty-free, worldwide licence to publish, reproduce, and adapt the content for IndiaNiva’s marketing, social media, website, and editorial purposes. We will always credit you by name or social handle unless you request anonymity.

This licence is revocable — see section 6.3 below.

6.3 Right to remove

You can request removal of your UGC at any time by emailing info@indianiva.com with the subject “UGC Removal Request” and a description of the content. We will remove the content from our website and social media within 14 days, subject to any technical limitations on third-party platforms (e.g. cached versions, reposts).

6.4 Content standards

IndiaNiva reserves the right to decline, edit, or remove submissions that are offensive, defamatory, misleading, or violate any law. We do not publish anonymous reviews of identifiable individuals (e.g. tailors in the directory) without verification.

7. Paid content and brand collaborations

IndiaNiva may engage in paid collaborations with brands, suppliers, or service providers. We commit to full transparency:

— Every paid post, sponsored article, affiliate link, or brand collaboration will be clearly marked with #ad, #Werbung, or #Anzeige as required under German competition law (§5a UWG).
— Sponsored content will state the brand name and the nature of the collaboration.
— Affiliate links will be disclosed at the point of recommendation.
— Editorial content remains independent — we will not write favourable reviews for products we don’t genuinely recommend, regardless of payment.

If you ever see a paid promotion on IndiaNiva without proper disclosure, please email info@indianiva.com — we will correct it immediately.

8. Educational content disclaimer

The Saree Guide, Fabric Guide, and other educational content is provided for informational purposes only. While we take care to be accurate, we are sharing publicly what we are learning. We are not professional textile experts or saree historians, and information may be simplified for European readers. We welcome corrections at info@indianiva.com.

9. Tailor Directory — how it works

The IndiaNiva Tailor Directory is a free, open, informational directory of Indian tailors in Germany and Europe. It is not a marketplace, agency, or booking platform. IndiaNiva does not employ, represent, or act as agent for any listed tailor. Any business transaction is between you (the customer) and the individual tailor.

9.1 Who can submit a tailor

Anyone — customers, tailors themselves, or third parties — may submit a tailor via our submission form. The submitter must confirm three things during submission:

— They have permission from the tailor to share the tailor’s contact information
— They accept that IndiaNiva will personally verify the tailor before publication
— They have read and accept the IndiaNiva Privacy Policy

Submitting a tailor without their consent is a misrepresentation. IndiaNiva will remove any listing where the tailor disputes the submission.

9.2 What appears publicly

Each published tailor listing shows: business name, full street address, services offered, languages spoken, years of experience, working location (home/shop/both), and a “More →” link to the tailor’s own external page (Instagram, Google Maps, or website). The tailor’s phone number, email address, and any submitter notes are never displayed publicly.

9.3 Verification

IndiaNiva personally contacts every submitted tailor before publication — typically within 7 to 14 days — to confirm their consent to being listed and to verify the accuracy of the information. Listings that fail verification are not published.

The “Verified” badge on a listing indicates that IndiaNiva has confirmed the tailor’s existence, basic credentials, and consent. It does not certify service quality, pricing, or specific outcomes.

9.4 Right to remove a listing

Any listed tailor — or someone with legitimate authority to act on their behalf — can request removal of their listing at any time by emailing info@indianiva.com with the subject “Tailor Directory Removal Request” and the listing name. We unpublish the listing within 14 days of receiving the request, typically much faster. Underlying data is then deleted within 12 months per our Privacy Policy.

9.5 No warranty of quality

IndiaNiva does not guarantee specific service outcomes, pricing, delivery times, or quality of work by listed tailors. The directory is an informational service to help users discover tailors who may meet their needs. Customers are responsible for evaluating the tailor and entering into any agreement on their own assessment.

9.6 Disputes between customers and tailors

Disputes about service quality, pricing, or delivery are between the customer and the tailor. IndiaNiva is not a party to these transactions and does not provide dispute resolution or mediation services. We do, however, take complaints seriously: if a listed tailor is repeatedly the subject of credible complaints, IndiaNiva reserves the right to remove or annotate the listing.

10. External links

Our site may link to external websites — including the external page of every tailor in our directory, and third-party legal/policy resources. We do not control those sites and are not responsible for their content, accuracy, or privacy practices.

11. Limitation of liability

indianiva.com is provided “as is” during Phases 1 and 2. We do not warrant that the site will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from use of the site or from interactions between users and listed tailors.

This limitation does not apply to liability for intent or gross negligence under German law, or any other liability that cannot be excluded under mandatory law.

12. Changes to these terms

These Terms of Use will be updated as IndiaNiva evolves through its five phases. Substantial changes — particularly the publication of full sale AGB before the Phase 3 shop launch, and the separate rental AGB before Phase 5 — will be communicated to waitlist members by email.

13. Applicable law and jurisdiction

These Terms of Use are governed by German law. Place of jurisdiction is München (Munich), Germany, where the operator is based.

Verify before launch

Before the Phase 3 shop launch, full sale Allgemeine Geschäftsbedingungen (AGB) must be drafted by a qualified German Anwalt or generated through Trusted Shops / eRecht24 Premium / IT-Recht Kanzlei. The sale AGB must cover: contract formation, prices and payment, shipping and delivery, returns and withdrawal right (Widerrufsbelehrung), warranty (Gewährleistung), data protection references, and dispute resolution.

Before the Phase 5 launch, a separate rental AGB must be drafted — rental contracts under §535 BGB are legally distinct from sale contracts and require different terms covering deposit handling, condition inspection, damage assessment, late return fees, withdrawal rules specific to rental, and customer verification.

These cannot be created using placeholder text — they must be professionally generated and verified.
